DMCA Policy

Zulmaved respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998, we will respond promptly to claims of copyright infringement committed using our service.

Notification of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our copyright agent as specified below. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  • An electronic or physical signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work that you claim has been infringed
  • Identification of the material that is claimed to be infringing and where it is located on the service
  • Information reasonably sufficient to permit Zulmaved to contact you, such as your address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law
  • A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner

Counter-Notification

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to the copyright agent identified above:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts for the judicial district in which your address is located, or if your address is outside of Ukraine, for any judicial district in which Zulmaved may be found, and that you will accept service of process from the person who provided notification of infringement or an agent of such person

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Zulmaved has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications to Policy

Zulmaved reserves the right to modify, alter or add to this policy, and all users should regularly check back to stay current on any such changes.

Processing of Notices

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the material claimed to be infringing
  • Notify the user who posted the material that it has been removed or access to it has been disabled
  • Provide the user with a copy of the complaint
  • Advise the user of the counter-notification procedure

If we receive a valid counter-notification, we will forward it to the complaining party and inform them that we may restore the removed material or cease disabling access to it in ten business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced, or access to it restored, in ten to fourteen business days after receipt of the counter-notification.

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. Please ensure that you are the copyright owner or authorized to act on the owner's behalf before submitting a DMCA notice.

Educational Use

Zulmaved operates an educational platform. We recognize that some uses of copyrighted materials in an educational context may qualify as fair use under copyright law. We carefully review all DMCA notices with this consideration in mind and may decline to remove content that we believe represents legitimate fair use.
